I'm not sure about the validity of the last paragraph: "Although it did lead to some anti-Roosevelt sentiment throughout the nation, the court-packing plan actually achieved its goal despite its defeat. Viewing the bill as an active threat by Roosevelt to remove opposing judges from the bench, conservative Justice Owen Josephus Roberts switched his vote in cases relating to the New Deal, breaking the deadlock and switching the majority to support of the New Deal."

There is considerable historical disagreement (particularly the work of Barry Cushman at the University of Virginia) on whether the court-packing plan actually contributed to the court's "switch in time." I think this disagreement should be noted, but want to see what opinions are before making this change. The story that this article now tells is the conventional middle school textbook story, not the story that students doing advanced study in law or history hear.


Fine with me. I'm not an expert on the court-packing thing, I just caught this & feel we shouldn't have two articles.
