I suppose that it is because of condition (5) that a 'taking a vehicle without the owner's consent' offence had to be introduced. Many people - 'joyriders' - were 'borrowing' cars.

I understand that there was a suggestion that a general crime of taking be implemented but that what was done instead was to make two particular crimes of taking (1) vehicles (and bicycles, although the punishment is a lesser one for a bike); and (2) works of art in collections open to the public -- there has been a spate of art students wanting works of art to "be" with them.
